UMA ANÁLISE DA SANÇÃO DE SUSPENSÃO DOS DIREITOS POLÍTICOS POR IMPROBIDADE ADMINISTRATIVA A PARTIR DAS DECISÕES DO STF ACERCA DA INTERNALIZAÇÃO DO PACTO DE SÃO JOSÉ DA COSTA RICA.

This article looks at the complexity of the thought processes that lead Seneca's Oedipus to choose the mors longa of blindness as punishment for his crime. It offers an analysis of the consolation of this existence on the threshold between life and death, notably with reference to the end of the Oedipus, but also of the sorrow of this liminal existence. The latter is described in Seneca's Phoenissae, which suggests an escape, by death stricto sensu, from the threshold represented by (...) blindness, by which Oedipus now feels trapped.By examining these three topics, the article shows how the threshold between life and death which Oedipus chooses at the end of Seneca's Oedipus and experiences in the Phoenissae mirrors the ambivalence and the errors of his life before he blinded himself. Ultimately, it also illustrates Oedipus’ continuing failure to achieve self-knowledge. (shrink)

A predominância dos temas literários e fenomenológicos nos textos sartrianos dos anos 1930 já chamou atenção de vários especialistas e comentadores da obra do autor. É notável, entretanto, como os exames dos textos dessa época contentam-se, no mais das vezes, em apontar o paralelismo ou a contemporaneidade entre fenomenologia e literatura ali presente, sem realçar a fundamentação que uma parece conferir à outra e que constitui uma das questões mais interessantes que a filosofia sartriana levanta. Há que se incluir, na (...) verdade, a estética literária de Sartre na compreensão de suas teses fenomenológicas; teses estas que, por outro lado, fornecem o solo filosófico da literatura sartriana, em termos tanto de autoria quanto de crítica. O propósito deste artigo é demonstrar, assim, uma dependência ou, se quisermos, implicação mútua entre literatura e fenomenologia não apenas central em relação àquele período da produção de Sartre como, também, determinante para seus projetos teóricos e ficcionais ulteriores. O desenvolvimento tecnológico promoveu o aumento de produção e compartilhamento de conteúdo em plataformas digitais, sendo difícil gerenciar o acesso adequado a informações. O presente artigo tem como objetivo discutir os efeitos do direito ao esquecimento no ambiente digital, considerando o processo de desindexação como estratégia para operacionalizar a efetividade desse direito. Tomando como referências arcabouços teóricos-conceituais acerca da complexidade compósita da informação e de antinomias entre a dignidade da pessoa humana e a liberdade de expressão e o direito à (...) informação, oriundos, respectivamente, da Ciência da Informação e do Direito, analisam-se e discutem-se algumas decisões jurisprudenciais e posicionamentos doutrinários no cenário brasileiro. O direito ao esquecimento está cercado de ambivalências e desafios de ordens normativa, tecnológica e cultural, num compartilhamento de informações em níveis sem precedentes que interferem negativamente na sua efetivação no ambiente digital. Na atual sociedade da informação, regida por políticas de acesso e de privacidade, o direito ao esquecimento surge como ferramenta de proteção dos direitos fundamentais do cidadão. Assim, discute-se algumas ambivalências que envolvem esse direito e sua efetiva sua aplicabilidade. No Brasil, não há uma legislação específica que verse sobre a aplicação do direito ao esquecimento e sua relação com a memória individual e coletiva, sendo realizados julgamentos com base na ponderação de direitos fundamentais oriundos da personalidade humana. Além disso, (...) Supremo Tribunal Federal considerou que o direito ao esquecimento é incompatível com a Constituição Federal, apontando para as análises de casos concretos que comentam excessos e abusos à liberdade de expressão e ao direito à informação. Considera, contudo, que o movimento de proteção de dados resultou em instrumentos normativos para atender às demandas sociais, políticas e econômicas do mundo contemporâneo, sobretudo, na produção dos direitos de personalidade. The neural correlates of software programming skills have been the target of an increasing number of studies in the past few years. Those studies focused on error-monitoring during software code inspection. Others have studied task-related cognitive load as measured by distinct neurophysiological measures. Most studies addressed only syntax errors. However, a recent functional MRI study suggested a pivotal role of the insula during error-monitoring when challenging deep-level analysis of code inspection was required. This raised the hypothesis that the insula is (...) causally involved in deep error-monitoring. To confirm this hypothesis, we carried out a new fMRI study where participants performed a deep source-code comprehension task that included error-monitoring to detect bugs in the code. The generality of our paradigm was enhanced by comparison with a variety of tasks related to text reading and bugless source-code understanding. Healthy adult programmers participated in this 3T fMRI experiment. The activation maps evoked by error-related events confirmed significant activations in the insula [p < 0.05]. Importantly, a posterior-to-anterior causality shift was observed concerning the role of the insula: in the absence of error, causal directions were mainly bottom-up, whereas, in their presence, the strong causal top-down effects from frontal regions, in particular, the anterior cingulate cortex was observed. O texto tematiza em que sentido a experiência de Alfabetização filosófica se inspira e ao mesmo tempo se diferencia do curso de Alfabetização oferecido por Paulo Freire em (...) Angicos em 1963. Inspirado na curiosidade e no compromisso de Paulo Freire com os esfarrapados do mundo, o conceito “alfabetização filosófica” propõe uma formação experiencial sustentada nas seguintes disposições: escutar atentamente o mundo humano e não humano que nos rodeia; pensar juntos com cuidado e calma; relacionarmo-nos cooperativa e não competitivamente com as ideias das outras pessoas; perguntarmo-nos, colocando em questão, nossa vida e a maneira como nos relacionamos com ela, num tempo especial, singular, suspendido; conversar como iguais na busca de enfrentar as exigências de nossa comunidade; inventar novas formas de estar com outras e outros. With the analysis and reduction of capital into labor, the possibility of freedom in this new meaning, which is merely asserted in the "humanism" of his earlier writings, is proven and secured with the necessity of science. This is a collective study, in nine new essays, of the close connection between theology and cosmology in Stoic philosophy.

Contemporary theories of consciousness are based on widely different concepts of its nature, most or all of which probably embody aspects of the truth about it. Starting with a concept of consciousness indicated by the phrase “the feeling of what happens” (the title of a book by Antonio Damásio), we attempt to build a framework capable of supporting and resolving divergent views. We picture consciousness in terms of Reality experiencing itself from the perspective of cognitive agents. Each conscious experience is (...) regarded as composed of momentary feeling events that are combined by recognition and evaluation into extended conscious episodes that bind cognitive contents with a wide range of apparent durations (0.1 secs to 2 or more secs, for us humans, depending on circumstances and context). Three necessary conditions for the existence of consciousness are identified: a) a ground of Reality, envisaged as an universal field of potentiality encompassing all possible manifestations, whether material or 'mental'; b) a transitional zone, leading to; c) a manifest world with its fundamental divisions into material, 'informational' and quale-endowed aspects. We explore ideas about the nature of these necessary conditions, how they may relate to one another and whether our suggestions have empirical implications. (shrink)

In this paper I present a formalization of the theory of ideal concepts applied to the concept of God. It is done within a version of the Simplest Quantified Modal Logic (SQML) and attempts to solve three meta-problems related to the concept of God: the unicity of extension problem, the homogeneity/heterogeneity problem and the problem of conceptual unity.

Our doxastic states are our belief-like states, and these include outright doxastic states and degreed doxastic states. The former include believing that p, having the opinion that p, thinking that p, being sure that p, being certain that p, and doubting that p. The latter include degrees of confidence, credences, and perhaps some phenomenal states. But we also have conviction (being convinced simpliciter that p) and degrees of conviction (being more or less convinced that p). This volume shows: how and (...) why all of the outright doxastic states mentioned above can be reduced to conviction thresholds; what degrees of conviction fundamentally are (degreed reliance-dispositions); why degrees of conviction are not credences; when suspending a belief is compatible with continuing to believe; and the surprising extent to which Kant endorsed the theory of conviction that emerges in this volume. Este artigo oferece uma visão da discussão filosófica contemporânea sobre o especismo. Após uma breve introdução, apresenta-se uma definição de especismo e caracterizam-se vários tipos de especismo, sendo o Antropocentrismo o mais (...) relevante. Depois, expõe-se um argumento proeminente contra o Antropocentrismo: o argumento dos casos marginais. Por fim, algumas posições antropocêntricas são criticamente discutidas. (shrink)

This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. This essay is a defense of the social construction of racialism. I follow a standard definition of “racialism” which is the belief that “there are heritable characteristics, possessed by members of our species, that allow us to divide them into a small set of races, in such a way that all the members of these races share certain traits and tendencies with each other that they do not share with other members of any other race”. In particular I want to (...) defend the “radical” social-constructive thesis that holds “the concept of race is exclusively the product of historical and cultural causes. It claims that humans do not tend to classify people into races when groups with different phenotypes meet, save for particular historical circumstances”. The quoted position is the consensus view among historians, sociologists, anthropologists, and other social scientists who study racialism but has recently been criticized by philosophical defenders of cognitive/evolutionary psychological approaches to racialism. Drawing on developmental studies as well as historical and contemporary cross-cultural research, CEP philosophers point to similarities of racialism across time and space. They hold that social constructionist approaches to racialism cannot explain these similarities. I hold that SC approaches do explain these similarities and that such similarities actually pose a significant challenge to the proposed CEP research program on racialism. (shrink)

Este artigo intenta apresentar uma visão panorâmica da complexidade histórica das relações entre sociedade, estado e meio ambiente no Brasil. Argumenta que a genealogia dessas relações evidencia uma trajetória não linear, multifacetada e conflituosa. Há diversas tradições no palco dos confrontos políticos atuais: o Brasil se destaca por uma longa história de destruição, que remonta ao início da colonização do território, mas também por uma fértil tradição de pensamento conservacionista, significativas lutas socioambientais, e pelo pioneirismo nas pautas globais em prol (...) do ambiente. Recuperar e valorizar a complexidade das relações entre sociedade e ambiente pode ser um ato decisivo na construção de caminhos futuros diversos para a questão socioambiental no Brasil, projetando e demonstrando a riqueza e o vigor de diferentes atores e práticas dissonantes. Charles Griswold has written a comprehensive philosophical study of Smith's moral and political thought. Griswold sets Smith's work in the context of the Enlightenment and relates it to current discussions in moral and political philosophy. Smith's appropriation as well as criticism of ancient philosophy, and his carefully balanced defence of a liberal and humane moral and political outlook, are also explored. I explain why, from the perspective of knowledge-centric anti-luck epistemology, objective act consequentialist theories of ethics imply skepticism about the moral status of our prospective actions and also tend to be self-defeating, undermining the justification of consequentialist theories themselves. For according to knowledge-centric anti-luck epistemology there are modal anti-luck demands on both knowledge and justification, and it turns out that our beliefs about the moral status of our prospective actions are almost never able to satisfy these demands if objective act (...) consequentialism is true. This kind of applied moral skepticism introduces problematic limits on our ability to use objective act consequentialism’s explanatory power as evidence for its truth. This is, in part, a product of higher-order defeat as I explain in the final section. There is, however, a silver lining for objective act consequentialists. For there is at least one type of objective act consequentialism, prior existence consequentialism, that is poised to avoid at least some of the epistemic problems discussed in this paper. (shrink)

In this essay, I focus on Lugones’s relatively lesser explored notion of playfulness. I weigh in on the debate about whether playfulness is necessary for what Lugones calls “world-traveling,” which enables one to recognize another person as a full subject. I argue that although the attribute of playfulness may not be necessary for world-traveling, it is necessary for collaborative world-making––creating a new, shared world that is opened through the activity of play.

O estudo do valor é indissociável da análise dos conceitos de bom e Bem, pelo que qualquer base metodológica que lhe sirva de alicerce tem de partir do exame destes. Assumindo os riscos do sem-sentido, recusamos uma redução relativista do bom predicativo a bom atributivo e de bom a bom para, bom do ponto de vista de, bom relativo a, e avançamos para a discussão de algumas tentativas de identificação do bom, nomeadamente com o prazer, o desejo e o escolhido. Seguindo-se o esforço de mostrar como bom é insusceptível de uma remissão para o psicológico ou para o subjectivo, o ensaio procura evidenciar a ideia de Bem como o conceito fundamental e indefinível para a compreensão do bom, a partir da sua estruturação teleológica. Propomo-nos, portanto, estabelecer bom = aquilo que remete para o Bem, sendo o conceito de valor o reflexo da relação mediada com o Bem, indissociável do domínio ético. Por fim, consagra-se a possibilidade de uma nova fundação de um método na teoria do valor baseado nos preceitos alcançados, distinguindo-se o estudo do valor em analítico, substantivo e prático. The study of value is inseparable from the analysis of the concepts of good and the Good, so any methodological basis which serves as groundwork must take from these. Assuming the risks of non-sensicality, we propose to refuse a relativistic reduction of predicative good to attributive good and of good to good for, good from the point of view of and good-relative-to and discuss some attempts to identify good, particularly with pleasure, desire and choice. Following the effort to show how good is not liable to be ascribed to the psychological or subjective, the essay seeks to highlight the idea of the Good as the fundamental concept - therefore undefinable - to understand good as from its teleological structure. We therefore propose to establish good = what refers to the Good, and the concept of value as one which reflects the mediated relationship with the Good, inseparable from the ethical. Finally, we establish the possibility of a new foundation of a method of the theory of value based in the reached percepts, distinguishing between analytical, substantive and practical inquiries on value. Interpreting Figurative Meaning critically evaluates the recent empirical work from psycholinguistics and neuroscience examining the successes and difficulties associated with interpreting figurative language. There is now a huge, often contradictory literature on how people understand figures of speech. Gibbs and Colston argue that there may not be a single theory or model that adequately explains both the processes and products of figurative meaning experience. Experimental research may ultimately be unable to simply adjudicate between current models in psychology, linguistics and philosophy (...) of how figurative meaning is interpreted. Alternatively, the authors advance a broad theoretical framework, motivated by ideas from 'dynamical systems theory', that describes the multiple, interacting influences which shape people's experiences of figurative meaning in discourse. This book details past research and theory, offers a critical assessment of this work and sets the stage for a new vision of figurative experience in human life. (shrink)

In this paper we propose that the term skill acquisition, as commonly used in traditional psychology, and the philosophy, education, movement science and performance development literatures, has been biased by an organismic asymmetry. In cognitive and experimental psychology, for example, it refers to the establishment of an internal state or representation of an act which is believed to be acquired as a result of learning and task experience. Here we elucidate an ecological perspective which suggests that the term skill acquisition (...) may not refer to an entity but rather to the emergence of an adaptive, functional relationship between an organism and its environment, thus avoiding an inherent organismic asymmetry in theorizing. In this respect, the terms 'skill adaptation' or 'skill attunement' might be more suitable to describe this process. (shrink)

In earlier work, the author has studied the economic role of planning horizons in making a case for complementarity as the predominant feature of social interdependence. This paper compares the different choice strategies implied by substitution, opposition and conflicts of interest in an economics of fear with those arising from horizon effects, economic complementarity and concerts of interest in an economics based on love. The contrasting implications of a psychological literature on negative vs. positive emotions and their health effects, along (...) with the findings in neurophysiological research about how humans are hard-wired for empathy and compassion leads to some fundamental changes in how we might address and revise social problems through economic analysis. The aim of this paper is to extend a horizonal case for complementarity in the author's previous work into its psychological links to research findings on healthy cognitive function and its emotional basis. An economics of substitution yields quite different conclusions about optimal institutional forms and how we address and frame social relations than are implied by an explicitly horizonal economics of complementary social relations. Recent psychological and neurophysiological studies support a horizonal case for complementarity in social relations, showing that our orthodox substitution assumptions and models of competitive equilibrium should be rejected for a renewed economic analysis based on horizonal models of complementarity and cooperation as a means to achieve greater social well-being in a healthier and more integrative form of social organization. The issues to be explored are not entertained within the currently existing frame of orthodox economics, so we must step beyond our standard habitual assumptions. (shrink)

This enormous expanse of land covered by tropical forest of unequalled beauty, extending over several Brazilian states, possesses an extremely rich biodiversity, with a vast potential reserve of natural resources of all sorts, and inspires admiration as well as inevitable greed. The intensification of human activity in the region has given rise to problems such (...) as deforestation and a resulting loss of organic matter whose importance has yet to be properly evaluated; it has also led to conflict between the different local groups, such as the indigenous population, gold prospectors and the big landowners, and to the degradation of quite extensive areas, thus provoking questions on how best to promote sustained development in the region. Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

Expressions of the form 'S is aware of the fact that p' are commonplace. This book provides a systematic exploration of the relation between knowledge and factual awareness, arguing that knowledge is but one species of factual awareness and that we can understand the possession of objective reasons, the normativity of knowledge, and the nature of knowledge in terms of factual awareness. In this way, the state of factual awareness is, structurally and substantively, a more basic type of state than (...) knowledge. If correct, this undermines a number of ways in which knowledge has been regarded as ‘first’ in recent epistemology. (shrink)
